FAQ

Frequently asked questions.

Yes, in most cases a foreign national may purchase property in Italy even without being a resident. However, it’s necessary to check for any reciprocity agreements between Italy and the investor’s country of origin. It’s also essential to carry out proper legal due diligence and assess the tax implications, both in Italy and in the country of residence.

Timeframes vary depending on the structure chosen and the completeness of the documentation, but under normal conditions a company can be set up within a few weeks. It’s important to define the most appropriate legal form from the outset and properly structure the articles of association, governance and liabilities to avoid subsequent amendments.

Not always. In many cases it’s possible to proceed by means of a power of attorney or delegation, avoiding the need for continuous physical presence in Italy. However, each transaction must be assessed on a case-by-case basis to ensure full legal validity and regulatory compliance.

The most common risks concern planning irregularities, restrictions on the property, inadequately structured corporate liabilities and unplanned tax implications. Preventive legal advice makes it possible to identify and mitigate these risks before finalising the transaction.

Yes. Our support doesn’t end with the initial stage of the transaction. We provide ongoing assistance in contractual, corporate and real estate matters, ensuring stability, protection and continuous alignment with developments in Italian regulations.
